Like all +3 weapons, the DM will add +3 to the AC hit when using this weapon but the damage bonus has already been factored into the damage wheel.
If the owner of this weapon dies, s/he gains the speak with living ability and may freely converse with living party members. Speak with living does not grant the ability to attack, cast spells, physically affect the environment, or anything other than talk to living party members. All dead characters–whether they have this item or not–are free to talk to each other, with or without the aid of magic items or spells.
Note: The character does not need to be wielding this weapon at the time of death to gain the speak with living ability, but the player does need to have the token on her/his person to show the DM when requested.
